1. Introduction

Welcome to Silly Beaks ("we," "our," "us"), a brand owned and operated by Aperto Samudra LLP, having its registered office at C-2, FLR-1, P-29A, Singhania Building, Balaram Street, Mumbai, Maharashtra 400007. By accessing sillybeaks.com (the "Website") or purchasing our products, you agree to these Terms of Service. If you don’t agree, please don’t use the Website.

2. Eligibility

You must be at least 18 years old to use this Website, or use it under the supervision of a parent or guardian who accepts these Terms on your behalf.

3. Account Registration

You may create an account to make purchases easier. You're responsible for providing accurate information, keeping your login details confidential, and any activity that happens under your account.

4. Our Products

•         Every Silly Beaks design is created by us. We are not officially licensed by, affiliated with, or endorsed by any studio, publisher, sports league, or other rights holder referenced or evoked by our designs. Any resemblance to existing characters, teams, or properties is original fan art, created independently.

•         Each tee is printed to order once you place it, since we don't hold pre-made stock. Because of this, minor variations in colour shade or print placement between what's shown on screen and what you receive are normal and not a defect.

•         Product images are for representation; your screen's display settings can affect how colours appear.

•         Products are subject to availability. We may limit quantities, discontinue a design, or change prices without prior notice.

5. Pricing and Payment

•         Prices are listed in INR and include applicable GST (currently 5% on our apparel) unless stated otherwise.

•         Payments are processed through Razorpay, an RBI-regulated payment aggregator. We never see or store your card details.

•         We accept UPI, credit/debit cards, net banking, and Cash on Delivery on eligible orders.

•         If payment fails, your order will not be processed.

6. Order Confirmation and Cancellation

•         Once placed, your order is sent to production quickly to keep delivery times short, which means the cancellation window is short too.

•         You can cancel or change an order within a few hours of placing it, before it enters production: email info@sillybeaks.com immediately with your order number. Once in production, we're unable to cancel, modify, or refund the order except as described in our Returns and Refund Policy.

•         We reserve the right to cancel any order due to a printing/stock issue, pricing error, suspected fraud, or an undeliverable address. If we cancel after payment, you'll receive a full refund.

9. Intellectual Property

•         Everything on this Website, including our logo, the Silly Beaks name, the pelican mascot, and our designs, belongs to Aperto Samudra LLP and may not be reproduced or used without written permission.

•         Our designs are original, fan-inspired work and are not officially licensed merchandise (see Section 4).

•         You may not reproduce, redistribute, or resell content from this Website.

10. User Conduct

You agree not to:

•         Use the Website for unlawful purposes

•         Attempt unauthorized access to our systems

•         Upload malicious code

•         Interfere with the Website's functioning

•         Misuse promotional codes

•         Submit false information

11. Reviews and User Content

Reviews or content you submit must be honest and lawful. We may remove content that violates these Terms. By submitting content, you grant us a non-exclusive, royalty-free licence to use it for promotional purposes.

12. Disclaimers

The Website is provided "as is." We don’t guarantee uninterrupted or error-free access, and make no warranty about the completeness of information on the site.

13. Limitation of Liability

To the extent permitted by law, Silly Beaks / Aperto Samudra LLP is not liable for indirect or consequential damages arising from your use of the Website. Our total liability for any claim is limited to the amount you paid for the order in question.

14. Indemnification

You agree to indemnify Silly Beaks / Aperto Samudra LLP against claims arising from your violation of these Terms or misuse of the Website.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

16. Dispute Resolution

We encourage resolving issues directly: contact our Grievance Officer first (see Contact section). Unresolved disputes will be referred to arbitration under the Arbitration and Conciliation Act, 1996.

17. Tax Compliance

All applicable GST is included in the displayed price. Our GSTIN is 27ACPFA1725M1Z2, shown on every invoice.

18. Changes to These Terms

We may update these Terms at any time. Continued use of the Website after changes means you accept the revised Terms.
